Terms of Service

These terms govern your use of Elimu360, the marketplace connecting schools, suppliers, parents, and shoppers. By creating an account or using the platform, you agree to them.

1. Acceptance of these terms

By registering for an account — as a school admin, vendor, parent, or shopper — or by otherwise using Elimu360, you agree to these Terms of Service and our Privacy Policy. If you don’t agree, please don’t use the platform.

2. Account types and eligibility

You must be at least 18 years old to create an account. Elimu360 supports four account types:

  • School admin — registers and manages a school’s presence, RFQs, and orders.
  • Vendor — lists products, responds to RFQs, and fulfils orders, subject to KYC verification.
  • Parent — links to a school account to manage fees, orders, and financing on a student’s behalf.
  • Shopper — browses and purchases products directly from verified vendors.

You’re responsible for the accuracy of the information you provide when registering, including business or school details submitted during onboarding.

3. Your account and security

Keep your password confidential and notify us immediately at support@elimu360.co.ke if you suspect unauthorized access. You’re responsible for activity that happens under your account, including through Google or Facebook sign-in linked to it.

4. Elimu360’s role in the marketplace

Elimu360 is a marketplace that connects buyers (schools and shoppers) with independent vendors. We are not a party to the underlying sale — vendors are solely responsible for the accuracy of their listings, the quality and legality of their products, and fulfilling orders. Elimu360 does not manufacture, own, or take title to any products sold through the platform.

5. Vendor obligations

  • Complete KYC verification truthfully, including business registration, KRA PIN, tax compliance, and business permit documents.
  • List products accurately, including price, availability, and description.
  • Respond to RFQs and orders in good faith and within a reasonable time.
  • Fulfil confirmed orders, provide accurate shipment tracking, and honor stated delivery timelines.
  • Comply with all applicable Kenyan consumer protection, tax, and trade laws.

Elimu360 may suspend or reject a vendor account where verification fails, or where a document is rejected and not corrected within a reasonable time.

6. Buyer obligations

Schools and shoppers agree to provide accurate RFQ and order details, and to pay for confirmed orders through the platform’s supported payment methods. Cancellations after a vendor has confirmed and begun fulfilling an order may be subject to the vendor’s own cancellation terms.

7. Financing

Elimu360 may connect you with third-party financing partners — currently Premier Credit, Momentum Credit, and Platinum Credit Ltd — for working capital, equipment, or purchase-order financing. Elimu360 is not a lender. Any loan or credit facility is issued solely by the financing partner, under that partner’s own terms, interest rates, and approval criteria. We don’t guarantee approval, and any dispute about a loan is between you and the financing partner.

8. Payments and fees

Orders are paid through the platform’s supported payment methods, in Kenya Shillings (KES) unless stated otherwise. Elimu360 may charge vendors a service fee on completed transactions, as disclosed at the time of listing or in a separate vendor agreement. Payouts to vendors are processed after order completion, subject to the payout method the vendor has set up and approved.

9. Reviews and ratings

Shoppers and schools may leave one review per delivered order item. Reviews must reflect a genuine transaction and comply with our content standards — no harassment, false claims, or off-platform contact information. We may moderate or remove reviews that violate these standards.

10. Prohibited conduct

  • Listing counterfeit, stolen, or illegal goods.
  • Submitting false or forged verification documents.
  • Circumventing the platform to complete transactions off-platform to avoid fees.
  • Interfering with the platform’s security, or scraping data without permission.
  • Harassing other users or posting fraudulent reviews.

11. Intellectual property

The Elimu360 name, logo, and platform design are owned by Zynamis Ltd. Vendors retain ownership of their own product content but grant Elimu360 a license to display it on the platform for the purpose of operating the marketplace.

12. Suspension and termination

We may suspend or terminate an account that violates these terms, fails verification, or poses a risk to other users. You may close your account at any time by contacting support; open orders or financing applications must be resolved first.

13. Disclaimers and limitation of liability

Elimu360 is provided “as is.” We don’t guarantee that the platform will be uninterrupted or error-free, or that any vendor’s products will meet your expectations. To the fullest extent permitted by Kenyan law, Elimu360’s liability for any claim arising from your use of the platform is limited to the fees you paid to Elimu360 in the three months before the claim arose.

14. Governing law

These terms are governed by the laws of Kenya. Any dispute that can’t be resolved informally will be subject to the exclusive jurisdiction of the courts of Kenya.

15. Changes to these terms

We may update these terms from time to time. Continuing to use Elimu360 after an update means you accept the revised terms. We’ll flag material changes through the platform or by email.
